Timber Rights Holdings

The new Legislative Instrument, LI 2254, distinguishes three categories of timber rights in Ghana, namely Large Scale Timber Utilisation Contracts (TUCs) Small Scale Timber Utilisation Contracts and Salvage Permits. Under the LI, holders of leases are expected to apply to the Forestry Commission to convert their lease-holdings to TUCs within six months of the promulgation of the law.

Legal Timber Trade

A VPA partner country that has implemented a timber legality assurance system and other VPA commitments can issue verified legal timber products with FLEGT licences. The advantage is that FLEGT-licensed products automatically meet the requirements of the EU Timber Regulation (EUTR), which prohibits EU operators from placing illegally harvested timber and timber products on the EU market.

Overview - Procedure for Allocation of Timber Utilization Contracts (TUCs)

A major policy reform in the forestry sector in Ghana is the introduction of a competitive system  of allocation of the timber resource. These reforms are based on Legislative Instrument (LI 1721), and its parent law, Act 547 (also amended in Act 617). Under the new system, allocation of timber utilization contracts (TUCs) will be on the basis of public bidding for rights to harvest timber in each area on the basis of an annual Timber Rights Fee. TUCs for Forest Reserves will have a term of forty (40) years, while TUCs for other lands will have a term of five (5) years.

As part of the allocation process, a floor price would be set for each bidding area/lot. The floor price would be set by an independent third party (ITP) who would also maintain the confidentiality of the floor price until the bid opening on the bidding day.
